Negligence claims remain a constant concern for all property professionals and that concern has been sharpened by recent case law. The purpose of this course is to review the position of professionals managing their risk exposure and dealing with potential liability disputes. It includes the issues which arise when professionals offer expert evidence to courts and when they serve as expert witnesses. This course will be of interest to both surveyors and other built environment professionals who have been exposed to risk and who have taken, or considered taking, appointments as expert witnesses.

The course covers:

  • a refresher on principles of liability
  • the duty of the property professional
  • liability for valuation in unstable markets
  • the role of expert evidence: ‘the margin of error’
  • liability of expert witnesses: a whole new world since Jones v Kaney
  • relevant recent case law

Anthony Lavers is the Consultant Editor to the RICS books ‘Case in Point’ series, in which he co-authored the ‘Expert Witness’ title. He is Counsel in the Construction & Engineering Group at international law firm White & Case and Visiting Professor of Law at the University of Portsmouth and at Oxford Brookes University.
