In a recessionary environment the outcomes of rent reviews and lease renewals have a critical importance for the businesses of both landlords and tenants because the rent fixed and the terms agreed have a significant impact on investment values and on occupational costs. This session will help all involved both directly and indirectly to
understand the process, to appreciate the art of negotiation and what is capable of being achieved through negotiation. It also examines how things change when the matter is referred to an independent expert, an arbitrator or a court. The course examines the context, explains current practice and draws on extensive experience.
The course covers:
- the context
- understanding clients’ expectations
- identifying a solid base for negotiations
- arriving at a negotiated settlement
- differences in approach between independent expert and advocate
- preparing reports to third parties
- making effective use of Calderbank offers
Mike Pain is a Landlord and Tenant expert in the office, industrial and warehouse sectors and acts for many UK and international clients. He has appeared as expert witness at court, at valuation tribunals, at planning inquiries and in oral arbitrations and he lectures at the University of Westminster.
